Recorded TV Manager End-User License Agreement

IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you and Drasch Computer Software (“DCS”) for the Recorded TV Manager software (“RTV”). RTV is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties and is licensed, not sold.

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS.  IF YOU DO NOT AGREE WITH THEM, YOU SHOULD NOT INSTALL THE SOFTWARE.  LOADING OF THE SOFTWARE ONTO A COMPUTER INDICATES YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS:

GRANT OF LICENSE: DCS grants you a nonexclusive license to use RTV internally (at the location to which it is downloaded) and make whatever copies necessary to use the software effectively.

RESTRICTIONS:  Reproduction, reverse engineering, disassembly, use for any purpose other than intended, and/or distribution by any means of RTV are prohibited.  Any attempt to transfer any of the rights or obligations hereunder is void.

TERMINATION: This license will immediately and automatically terminate without notice if you fail to comply with any term or condition of this EULA.  You agree upon termination to promptly destroy the RTV Software together with all copies and component parts.

WARRANTY DISCLAIMER: The RTV software is provided "AS IS" and without warranty of any kind.  DCS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LIMITATION OF LIABILITY: IN NO EVENT WILL DCS BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING LOST PROFITS OR DATA, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF THE USE OR INABILITY TO USE RTV OR ANY DATA SUPPLIED THEREWITH, EVEN IF DCS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.

GENERAL: This EULA will be governed by the laws of the State of Connecticut, USA. If any provision of this EULA is held to be unenforceable, that provision will be removed and the remaining provisions will remain in full force.  For International Users: This EULA has been written in the English language.  By loading RTV you waive any rights you may have under the law of your country to have this EULA written in the language of that country.  Should you have any questions concerning this Agreement, you may contact DCS at support@fjdrasch.com.
